African Global Trade Institute (AfGTI)
1. Introduction
These Terms and Conditions ("Terms") govern the relationship between the African Global Trade Institute (AfGTI) and you ("the User/Student"). By ticking "I Agree" or accessing our Tutor LMS platform, you enter into a legally binding contract governed by the laws of the Republic of South Africa.
2. Course Registration & Access
- License: Upon payment, AfGTI grants you a personal, non-exclusive, non-transferable license to access course materials for your own educational use.
- Account Responsibility: You are solely responsible for maintaining the confidentiality of your login credentials. Any activity occurring under your account is deemed to be your own.
- Unauthorized Use: Sharing credentials or "group-buying" access is a material breach and will result in immediate termination without refund.
3. Professional Disclaimer (No Guarantee)
- Educational Purpose: AfGTI provides vocational training. While we strive for excellence, we do not guarantee employment, specific salary increases, or the success of any commercial trade ventures undertaken by the student.
- Accuracy: We make every effort to ensure content is up-to-date; however, global trade regulations change rapidly. AfGTI is not liable for errors or omissions in course content. Payment processing may be handled by third-party providers.
4. Fees, Taxes and Payments
- Pricing: All prices are inclusive of VAT (if applicable) unless stated otherwise.
- Non-Payment: AfGTI reserves the right to suspend access to the LMS and withhold certification if any part of the course fee remains unpaid.
5. Intellectual Property
All course materials, content, videos, documents, and resources are the intellectual property of AfGTI and are thus the exclusive property of AfGTI unless otherwise stated.
You may not:
- Reproduce, distribute, or share course materials.
- Use "screen-scraping" software.
- Record or redistribute training sessions.
- Use course materials for commercial purposes without written consent.
6. User Conduct
You agree not to:
- Engage in disruptive or abusive behaviour.
- Attempt to breach platform security.
- Upload malicious software.
- Share login credentials.Consequences: Termination for conduct violations results in the immediate forfeiture of all fees paid.
7. Limitation of Liability
AfGTI provides training and educational services. While every effort is made to ensure accuracy of content:
- AfGTI does not guarantee specific commercial or professional outcomes.
- AfGTI shall not be liable for indirect, incidental, or consequential damages arising from use of its services.
- To the maximum extent permitted by the Consumer Protection Act, AfGTI’s total liability for any claim shall not exceed the total amount of fees paid by the student for the specific course in question.
Force Majeure: AfGTI shall not be liable for failures to provide service due to causes beyond our control, including but not limited to: power outages (load-shedding), ISP failures, or civil unrest.
8. Privacy
Your personal information will be processed in accordance with our Privacy Policy and POPIA requirements.
9. Amendments
AfGTI may amend these Terms from time to time. Updated versions will be published on our website.
10. Governing Law and Dispute Resolution
These Terms are governed by the laws of the Republic of South Africa.
In the event of a dispute, parties agree to attempt an informal resolution via the AfGTI Information Officer first.
Should informal mediation fail, the matter shall be referred to the National Consumer Tribunal or the relevant court in the jurisdiction of Gauteng, South Africa.
